OK to Burn the US Flag, Just not The Gay One

The latest Flag Burning Amendment failed by one vote Wednesday as we all know by now, and all the Nays but 4 were democrats, here's the roll. What a surprise that was, not the dems voting against protecting the symbol of America, but the overall failure by one measley pathetic vote thanks to the three RINO's and one independent.

These so-called Republicans are going to pay in November.....wait, then again they know they probably won't since that could mean turning over house or senate control to the Dhimmi-crats.

But in news today from Ohio it's not ok, according to an Ohio appeals court, to burn a gay flag? God forbid one would offend the homosexual community by torching their flag as the men below decided to do, in fact I'm surprised it wasn't classified as a hate crime.

Free speech doesn't cover that act I guess? Well here some activist judges got creative and indicated that it would be against the fire code, a tact that will have to be used in cases that the US flag is burned as well one would hope.
first amendment center: "COLUMBUS, Ohio — A state appeals court has overturned a lower court ruling that a flag-burning was protected by the Constitution, saying a city has a right to regulate open burning.

The 10th Ohio District Court of Appeals ruled March 20 in the case of two men who burned a gay-pride flag during a parade in Columbus in 2001.

The men, Charles Spingola, 47, and Thomas Meyer, 49, both of Newark, had been charged with open burning, a first-degree misdemeanor punishable by as much as six months in jail.

But former Franklin County Environmental Judge Richard Pfeiffer ruled that the flag-burning was protected under the First Amendment guarantee of free speech." more

  1. This fits the responses to my POST Speech is written, drawn and/or spoken words.

    Physical destruction (crosses, flags, etc.) to threaten, intimidate or insult ANYONE is not SPEECH - it is a HATE CRIME. Burning a United States Flag (in the United States) is intimidating, threatens and is a personal insult to many U.S. citizens. In the least - breaking public "burn" laws.

    As for amending the Constitution being un important?!? Our flag is the most important symbol of our country isn't it! What better item to be part of our most important document.

    Lesser countries even know this and include it in there official documents.

    This has become of small importance to so many because "many" people now see the flag as more of a decoration than the important symbol it once was thanks to a couple of decades of improper use. Flags without beams directed to them not taken down at night, city fathers hanging flags on utility poles - thinking it was patriotic -as they rip, tangle and become just heaps of fabric. Ooops anger valve leak - I'll go quietly. Everyone reading this could think of more abuse without my assistance. ;-)

  2. It doesn't matter that it is a symbol. If you want to burn something you own, say, a copy of the Constitution or even the real thing if you somehow owned it, that is fine.

    As long as you do not intrude upon other people's rights, then there is no reason you should not be able to burn a flag.

    Sure, if you are breaking local laws about burning things in public, then it would be illegal to burn any sort of flag, American or that gay-pride flag in Columbus.

    It really doesn't matter if you find it insulting that the flag is burned; if I called you an idiot, is that a 'hate crime'? Last I checked, insults were not illegal.

    If your neighbor was burning American flags in his fireplace, or in a bonfire, you may feel like he is insulting you but he is not intruding upon your rights.

    I'm glad that those Republicans stepped across party lines and voted for what they knew was right.
